- We do not act on your behalf unless explicitly agreed to in writing
3.2 Client Responsibilities
You agree to:
- Provide accurate, complete, and up-to-date information
- Review all documents carefully before submission or signing
- Seek clarification when necessary
- Be solely responsible for filing documents with the court unless otherwise agreed
- Obtain independent legal advice where necessary
3.3 No Solicitor-Client Relationship
- Your use of our services does not create a solicitor-client relationship
- Communications are not protected by solicitor-client privilege
3.4 Fees and Payment
- All fees will be disclosed prior to engagement
- Payment is required before work begins unless otherwise agreed
- Fees are non-refundable once work has commenced
- Additional fees may apply for revisions, additional services, or new information at the Company’s discretion
3.5 Turnaround Times
- Any estimated estimated timelines are not guaranteed
- Delays may occur due to incomplete information, revisions, or external factors
3.6 Revisions
- Reasonable revisions are included if errors are due to our preparation
- Additional charges may apply for changes based on new or corrected client information, at the Company’s discretion
3.7 Limitation of Service
- Court rejections due to inaccurate or incomplete information (it is the responsibility of the client to verify accuracy and completeness of each form prior to filing)
- Court rejections due to judicial discretion
- Legal outcomes or decisions made by the courts
- Delays caused by courts or third parties
3.8 Communication
- Communication will occur primarily via email, or alternatively via telephone, unless another method is agreed to by the parties
- You are responsible for monitoring your email inbox and junk mail folder and responding in a timely manner
4. Compliance with British Columbia Law
The Client acknowledges and agrees that:
- All probate matters in British Columbia are governed by applicable legislation, including the Wills, Estates and Succession Act (British Columbia) and the Supreme Court Civil Rules (British Columbia).
- Pacific Probate Documents provides non-legal document preparation services only and operates in compliance with applicable laws governing non-lawyer services in British Columbia.
- The Client is solely responsible for ensuring that all documents filed comply with current court rules, filing requirements, and applicable legislation.
- Nothing in these Terms and Conditions shall be interpreted as the unauthorized practice of law.
- The Client understands that certain probate matters may require the involvement of a licensed lawyer in British Columbia, particularly in cases involving disputes, complex estates, or unclear testamentary documents.
5. Dispute Resolution: Mediation and Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the services provided:
5.1 Good Faith Negotiation
The parties agree to first attempt to resolve the dispute through good faith negotiations.
5.2 Mandatory Mediation
If the dispute is not resolved within a reasonable time, the parties agree to submit the matter to confidential mediation:
- Mediation shall take place in British Columbia
- A mutually agreed mediator shall be appointed, or failing agreement, one appointed by a recognized mediation provider in British Columbia
- Unless otherwise agreed, costs of mediation shall be born by the disputing party
5.3 Binding Arbitration
If the dispute is not resolved through mediation, it shall be resolved by final and binding arbitration, rather than court proceedings:
- Arbitration shall be conducted in British Columbia
- A single arbitrator shall be appointed by mutual agreement, or failing agreement, by a recognized arbitration body in British Columbia such as the BC Civil Resolution Tribunal
- The arbitration shall be conducted in accordance with the applicable provincial arbitration legislation
- The arbitrator’s decision shall be final and binding on both parties
- Judgment on the award may be entered in any court of competent jurisdiction
5.4 Exceptions
Nothing in this clause prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction
5.5 Confidentiality
All negotiations, mediation, and arbitration proceedings shall be confidential and without prejudice.
6. Eligibility
By using this Website, you confirm that:
- You are legally capable of entering into binding agreements
